Copyright & Ownership
All photographs and digital files created by James Newby are the intellectual property of the photographer and are protected by U.S. copyright law. James Newby retains full rights to all images at all times, unless otherwise agreed to in writing.
Usage Rights for Clients/Models
Clients and models are granted personal, non-commercial usage rights for images delivered to them. This includes sharing on personal social media, printing for personal use, and portfolio inclusion (with credit to the photographer).
Commercial Use
Commercial use, including but not limited to advertising, merchandise, resale, publication, or promotional campaigns, requires a separate written agreement and licensing fee.
Editing & Alterations
Clients and models may not edit, alter, or apply filters to images without written permission from the photographer. Cropping for social media formats is allowed.
Photographer’s Portfolio & Promotion
The photographer reserves the right to use images for portfolio display, website galleries, social media, exhibitions, print sales, and other promotional purposes.
Payment & Deposits
Session fees or deposits must be paid as outlined in the booking agreement. Deposits are non-refundable but may be transferred if the session is rescheduled with reasonable notice.
Model Release
By participating in a session, clients and models grant the photographer permission to use their likeness in images for portfolio, promotional, and artistic purposes unless otherwise agreed to in writing.
Color Rendering on Devices
All digital reproductions are processed in a color-managed workflow to ensure accurate color representation. However, we are all unique—and so are our displays. Each monitor or mobile device has different color capabilities, and individual settings can affect how colors appear.
I've done my best to show the true colors of the works, but due to the variability of displays and human perception, I cannot guarantee that the color you see will exactly match the Original or Reproductions.
